Attached is language proposed by the City of Greensboro designed to delay the
implementation date of the nutrient loading requirement provisions within the Jordan
Lake Stormwater Management for New Development rule (15A NCAC 02B.0265).
The language calls for the implementation date to be pushed from August 10, 2012 to
August 10, 2014. Based on our earlier conversations, the language is structured to
be added to SB 426 - Public Finance Laws/Municipal Service Dists., sponsored by
Sen. Clodfelter, which is scheduled for consideration in the House Rules Committee
on Monday evening, June 25, at 5:30pm.
I just sent this language to Sen. Vaughan who agreed earlier today to support this
change and to consult with Sen. Clodfelter tomorrow to gain his agreement in adding
this language to SB 426. I will let you know as soon as I have received an update
from Sens. Vaughan and/or Clodfelter.
Many, many thanks to all of you for your help in addressing this matter on such a
short timeline. As you are aware, the Greensboro Partnership and TREBIC join the
City in this request and greatly appreciate your and Sen. Berger's efforts on
our behalf.
Please feel free to contact me or City Manager Denise Turner-Roth with any
questions. I, Mayor Robbie Perkins, Marlene Sanford, (and potentially others) plan to
attend the Rules Committee meeting on Monday evening and we are happy to
provide any support necessary in this matter.

delegation. Rep. John Blust has offered to put forward an amendment supporting
this language. The city attorney's office is working on language for the amendment
for Rep. Blust to offer on Monday. Once the draft language is received, everyone will
have a chance to review it before it goes forward. the mayor will attend the
committee hearing at 5:30 on Monday to represent the city's position. Jason which

As an update, Don Vaughan finally received a call back moments ago from Sen. Clodfelter
regarding adding the JLR provision to his bill (SB 426) when it is heard in the House Rules
Committee this evening. Apparently, Clodfelter has been out of state since late last week.
Clodfelter stated that although he is the bill sponsor, the bill has essentially been gutted from its
original purpose and is now focused on other issues. (This isn’t uncommon late in legislative
sessions.) Clodfelter reported that we should touch base with Ruth Samuelson in the House (RMecklenburg
and Majority Whip) and Bob Atwater (D-Chatham/Durham) – who have both have an
interest in the bill in its current form. Don is reaching out to Atwater now and I’ve called John
Blust, asking him to reach out to Samuelson.
Great news about the forthcoming support letter from Burlington!
I’ll keep you posted.

Attached please find the June 19th Greensboro City Council Agenda and proposed ordinance for the
adoption of new development rules for the Jordan Lake drainage basin. This matter was place before
the Council on July 19th and was denied by a unanimous vote of 9 to 0. Prior to taking the vote to
deny the adoption of the new rules, Council indicated strong concern of the following matters:
1. DENER issued these rules to the City in May of 2012. This allowed the City only 90 days to
adopt these rules or fall out of compliance with current State regulations.
2. These proposed rules have the nominal stated purpose of reducing nutrient loading in the
Jordan Lake basin. There is conflicting science and strong disagreement as to whether these
proposed rules would actually result in any improvement in the nutrient levels of Jordan Lake.
3. These proposed rules will place a substantial burden upon new development in Greensboro
and Guilford County.
4. These proposed rules will place the City of Greensboro at a competitive disadvantage with the
surrounding Triad cities of Winston-Salem, Kernersville and High Point.
5. The intent of this vote was to communicate to our elected Representatives the desire of the
City to work with the State toward a more sensible, cost effective and scientifically based
resolution of the nutrient issues with Jordan Lake.
6. The proposed delay in implementation of these rules will allow time for this discussion.
