25. ID 15-0951 Resolution Requesting Approval of Lease Agreement with Say Yes to Education
0367-15 RESOLUTION APPROVING LEASE AGREEMENT WITH SAY YES TO EDUCATION
WHEREAS, after a national search, Guilford County is the next Say Yes to Education (Say Yes) community;
...WHEREAS, Say Yes provides an unprecedented opportunity for the community to work together to ensure that every graduate of Guilford County Schools can receive a post-secondary education;
...WHEREAS, Say Yes has requested to lease space for the Greensboro office at the Greensboro Public Library located at 219 North Church Street, said proposed lease presented herewith this day;
WHEREAS, the City has a designee on the Operating Committee, Scholarship Board and Community Leadership Council and through the development of taskforces there will be continued opportunities for collaboration and coordination which shall include the Greensboro Public Library;
WHEREAS, the proposed lease is for six years and Say Yes to Education will be responsible for all improvements to the space which is currently vacant;
WHEREAS, there will be minimal budget impact to the City as Say Yes to Education will be responsible for the improvements as well as all janitorial services, phone and data lines.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GREENSBORO:
That the proposed lease agreement presented herewith this day between the City of Greensboro and Say Yes to Education for space in the Greensboro Public Library located at 219 North Church Street is hereby approved

"...it is desirable for the City and in the public interest to formalize our partnership and continue to provide usage of City facilities with the Lessee who provides to the community at no cost:
(a) A national nonprofit that organizes and galvanizes whole communities around the goals of its students graduating from high school to be able to attain, afford and complete a post-secondary education...
(c) The City has a designee on the Operating Committee, Scholarship Board and Community Leadership Council and through the development of taskforces there will be continued opportunities for collaboration and coordination which shall include the Greensboro Public Library.
B. Lessee desires to lease the Premises and to operate in the manner contemplated by this Agreement as approved by the Bylaws of the Lessee, which includes but is not limited to: revitalizing communities by helping them give every public high school graduate access to college or other post-secondary scholarships...
...3. RENT: During the term of this Lease, Lessee shall pay to Lessor, without demand therefore and without any offset or deduction, the annual rent payable in advance in one lump sum. The initial Term Rent shall be One Dollar ($1.00), hereinafter referred to as the “Rent”.
...(a) All utilities will remain in the Lessor’s name. It is understood and agreed that the Lessee shall be responsible for phone and data lines.
...8. ALTERATIONS BY LESSEE: It is understood and agreed that the Lessee is responsible for making all improvements to the Premises. The cost of the improvements is approximately one hundred twenty thousand dollars ($120,000.00).

...(2) Lessor with or without terminating this Lease may immediately or at any time thereafter demand in writing that Lessee vacate the premises and thereupon Lessee shall vacate the Premises and remove there from all property thereon belonging to Lessee within three (3) days of receipt by Lessee of such notice from Lessor whereupon Lessor shall have the right to re-enter and take possession of the Premises...

Assistant City Manager Wilson stated there was one meter for utilities; spoke to the lack of the ability to split utilty cost; stated Say Yes would invest in facility improvements which would equal the fair market rate over a six year lease; confirmed there were no additional requests; spoke to breaking down barriers with wrap around services; stated the primary benefit would be connecting with the community services area; spoke to becoming a close knit community; the location to the Cultural Center and Library; support services for students; the various partners involved; and to capitalizing resources.

Manager Mary Vigue.
Assistant City Manager Vigue stated she would provide the resolution at the Say Yes Planning Committee meeting next week.

...WHEREAS, through fundraising, Say Yes and its local partners make it possible for a community ’s public high school graduates to receive full tuition scholarships to any in -state public college and university regardless of family income; said awards being granted after Pell grants and other financial aid have been taken into account;
WHEREAS, in September of 2015, Guilford County was announced as the next Say Yes to Education Community, representing the third Say Yes community nationally; to provide free tuition to Guilford County School graduates to in-state public colleges or universities;
WHEREAS, more than forty individuals, couples, foundations and businesses have raised $ 32.5 million to contribute to the Say Yes scholarship fund for Guilford County Schools which hopes to raise a total of $70 million.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GREENSBORO:
That it hereby recognizes George A. Weiss for his outstanding contributions and service to Guilford County and Say Yes to Education communities.

"25. ID 15-0643 Resolution in Support of a Memorandum of Understanding (MOU) Between Guilford County, the City Of Greensboro, the City Of High Point, Guilford County, Guilford County Schools and Say Yes To Education
Assistant City Manager Parrish noted that the item had been presented at the work session last week; and that staff was present to answer any questions.
Mayor Vaughan voiced that she was excited about the item; spoke to the economic impact that being a Say YES community would have on Greensboro; spoke to the benefits to the educational community; verified that the private sector had stepped up with donations to date; stated she hoped Greensboro was the successful choice; and asked for Council support of the item.

...Say Yes communities achieve a positive economic impact – a more educated labor force, incentives for businesses to start or relocate into a community, a stronger tax base, increased property values and revitalizes communities while assisting students and families to achieve a post-secondary education;
WHEREAS, Guilford County is the leading candidate to become the next Say Yes to Education Community and will provide the opportunity to work together so that every graduate of Guilford County Schools will be eligible to receive a college education or post-secondary certificate;
WHEREAS, Say Yes has challenged the community to meet an initial $28 million fundraising goal of forty percent (40%) of the overall $70 million endowment goal for local scholarships which could be available to the graduating class of 2016 and at this time, the community has partnered with local donors for approximately $ 15 million in pledges;
WHEREAS, upon the completion of six years collaboration with the national Say Yes organization each Say Yes city must take ownership of the effort and assume local responsibility for sustaining the scholarship endowment and for providing other support to students and their families;
That the City Manager is hereby authorized to execute a Memorandum of Understanding between the City of Greensboro and Say Yes to Education for Guilford County.
