Was Robbie Perkins Lying Then Or Is He Lying Now?

When Greensboro Mayor Robbie Perkins left his seat on the board of directors at Newbridge Bank he publicly stated he was doing so to spend more time with his family. I said it was because the Mayor was in trouble with the bank. From today's Greensboro News & Record:

"The judge’s order said that Perkins “deliberately” depressed his income, by, among other things, resigning his post on the NewBridge Bank board of directors.

Robbie Perkins denied that assertion.

He said he resigned because he could not pay the home equity line owed to NewBridge for the couple’s house, according to court documents."

Either he was lying then or he's lying now-- which is it?

If he's lying now then it's perjury. If he was lying then it's Federal charges of failure to disclose to stockholders as is required by Sarbanes–Oxley. Which is it, Mayor Perkins? Which crime would you rather face prosecution for?
