Take a look at the settlement agreement offered to Mr Martin:
It's impossible to comply with.
But there's also an out for Jeff in that Jeff hasn't used the domain http://www.FecundStench.com.for over 3 years, no longer owns it, has no content published there and has no control over the content there. The suit will almost certainly be thrown out of court for that reason alone.
Jeff has for over 3 years used http://fecundstench.wordpress.com/
Jeff's lawyers will argue that Jeff can't he held responsible for content that isn't on a website Jeff doesn't own. The plaintiffs will have to convince the court to allow them to file a second suit in order to successfully sue Mr Martin and because they waited over 3 years to complain about his old website they may find it hard to convince the court of the need.
Sadly, I'm afraid we're stuck with Fecund Stench a while longer. The suit will be thrown out of court if the lawyer for the plaintiffs doesn't drop the suit before going to court.
