"Q: What are the rules about lying to Congress?
A: ...there are a two key statutes governing perjury you need to be aware of: U.S. Code sections 1621 and 1001 of Title 18.
Section 1621 covers general perjury, and stipulates that anyone who "willfully and contrary to such oath states or subscribes any material matter which he does not believe to be true" is guilty of perjury and shall be fined or imprisoned up to five years, or both. Section 1001 covers false statements more generally, without requiring an oath. The section stipulates that "whoever, in any matter within the jurisdiction of the executive, legislative, or judicial branch of the government of the United States, knowingly and willfully" falsifies or conceals information, including before a congressional committee's inquiry, may also be fined or imprisoned up to five years.
In essence, in order to give Mrs. Clinton a pass, the FBI rewrote the statute,
inserting an intent element that Congress did not require.
The added intent element, moreover, makes no sense:
The point of having a statute that criminalizes gross negligence
is to underscore that government officials have a special obligation
to safeguard national defense secrets;
when they fail to carry out that obligation due to gross negligence,
they are guilty of serious wrongdoing.
The lack of intent to harm our country is irrelevant.
People never intend the bad things that happen due to gross negligence.
