When the People Speak, Council Should

From Roch Smith Jr in his article, A better way to improve City Council’s public forums:

"Public comments at city council meetings are not tempestuous simply because speakers and supporters are rambunctious by nature. It’s not a matter of football fans showing up instead of golf fans. Tumult arises when the response of council to a public concern is inadequate and people must, literally and figuratively, raise their voices. It has been that way for years.

Public comments at these forums don’t become heated just because people want to blow off steam. People come to these forums because they perceive a need for action and, history shows, the atmosphere gets raucous when elected officials side-step concerns and remain immune to facts brought to their attention."

When the people speak, Council should act. Listening alone isn't enough. Pretending to listen is even worse, sleeping through meetings is the worst kind of insult to the people they represent. And allowing it to continue for a decade or longer says they just don't care.






The original text I posted with that photo on Facebook in 2016 was taken from a City Council business meeting in which the City of Greensboro claimed no video was taken in response to several public information requests for videos from the meeting.

"Is that a video camera behind a sleeping Councilwoman Nancy Hoffman? And why does the City of Greensboro claim there was no video of that meeting?"

No further explanation was ever given.

It all comes back to bite....

Say Yes To Education-- The E-mails: Part 2

In Say Yes To Education-- The E-mails: Part 1 I posted my most recent e-mail sent to one school board member, one county commissioner and one city council member. The school board member quickly replied:

"I have deep concerns about Say Yes and so do people in the Black community.  I was stunned when Mary Vigue was hired and very disappointed in the decision making.

This effort could very well deepen our inequities.  I always say and firmly believe when poor and working class blacks and whites realize what's going on and gets together- this mess will end!"

My reply:

"Just be sure to pass it along to the rest of your board.
And thanks for your reply. You've expressed concerns about Say Yes in the past-- I've seen it. I'm not out to damn anyone in particular, I just don't understand why George seemingly went unheard when he presented so much evidence both publicly and privately.
I also know the N&R participated. Perhaps board members were mislead. If that was the case then it quickly needs to be made public and those responsible held accountable. Entire boards couldn't have participated in a Ponzi scheme like this. The money is freaking off shore and no one will say how much there is!
And this lady just hired for school superintendent???? She was voted a 95% disapproval rating by the teachers in Syracuse in 2014 and she gets hired here? She can't take care of 20,000 students so we give her 70,000? How could that happen? This is the UNCG Linda Brady scandal all over again."

The County Commissioner's reply:

I've not heard back from the County Commissioner. Should I hear back I will update.

Regretfully, our County Commissioners and City Council members think this is only the school board's problem but let's not forget that both City and County governments invested in what appears to be yet another Ponzi scheme.

Which I forwarded to not one but two Guilford County Commissioners, one Democrat and one Republican, on November 4, 2015:

"George has dug up something very important here. One of the funds that the money for Say Yes to Guilford's funding has been placed in has been dissolved and is no longer in existence. So where is the money? We're talking about what looks to be a huge chunk of $28 Million Dollars.

Now in case you are unaware, George is a financial genius and as much as people don't like him he knows the investment industry better than anyone you know including every person working for the city and county. He harped about the City Retirement Plan for over 2 years but despite the fact that John Hammer and others made him out to be crazy the City finally switched to the plan George was recommending. Of course, the only place it was reported was on EzGreensboro.com.

George and I are right far more times than we are wrong and the fact that people don't like the way we do things doesn't change a thing. And seriously, my son is dead, I've no dog in this fight and don't give a shit and don't intend to write or act on this issue. But with $28 Million at stake and the fact that I think both of you are pretty straight shooters I don't want to see you get your asses handed to you when this thing finally blows up.

And believe me, even if there were no George or Billy you could not stop a $28 Million Dollar Fraud from blowing up. Say Yes is falling apart all over the nation, somebody needs to be doing their homework. Someone already should have.

What was their reply? Same as before. Never heard back. They thought everyone would forget and even if George was right no one would ever know they had been warned. Three governing councils, the Guilford County School Board, Guilford County Commissioners and Greensboro City Council all jointly responsible for having lost over $28 Million Dollars of taxpayer money that could be providing educations to your children but is gone, gone, gone...

And despite all of our warnings no one from Guilford County, Guilford County Schools or the City of Greensboro ever bother to look up the Weiss Earnings and Loss Reports:


 And those reports don't even take into account the Say Yes to Education money Weiss is moving off shore.

 Are our local government entities being run by idiots who marvel at shiny things?

If I Were Mayor Of Greensboro: Part 23

“It is difficult to get a man to understand something, when his salary depends on his not understanding it.” -Upton Sinclair

And therein lies the problem. Even the people who might benefit the most fear standing up for better ideas when their paychecks are put at risk by those whose paychecks depend on the status quo system.

Such was the case when another Greensboro mayoral candidate, George Hartzman, attempted to get the City of Greensboro to increase the retirement packages of city employees. John Hammer of the Rhino Times, lied when he wrote that George was only trying to sell his investment services to the City. I know because I set in on the meeting along with several other interested persons.

Councilwoman Hoffman slept through most of the meeting.


Just as she often sleeps through important city business meetings.


Mr Hartzman's plan was simple.

The companies that manage your retirement packages don't do so by guessing which stocks to buy and sell-- they buy a software program which does the buying and selling for them. And anyone can buy the software if you have the money.

Then these investment companies charge you a brokerage fee for running your money through their software.

All Mr Hartzman was trying to do was get the City of Greensboro to cut out the middle men so that the brokerage fees could be reinvested in the retirement accounts rather than in the pockets of the brokers and money market managers.

The Federal government uses the same plan George suggested. So do several cities across the nation where all their retirees enjoy a higher return on their retirement savings with no increased cost to the taxpayers.

Seems to me, if we can increase the retirement packages of city workers without increasing cost to taxpayers then that would be the right thing to do.

But the Greensboro City Council and  City Management weren't interested in increasing the retirement benefits of City workers despite the fact that it could be done so while reducing costs in the long run. Since no one on Council and no one on City staff every explained why the answer was no, I can only assume the quote by
Upton Sinclair above must explain the reason why.

And understandably, City workers didn't rise up for fear of getting fired.

If I were Mayor of Greensboro we would buy the software package and increase the retirement benefits of our City workers because it's the right thing to do for Greensboro.

Hartzman blackballed

Triad business interests and North Carolina state government officials have issued verbal warnings to reporters, commentators and news media personalities whose public remarks on the economy are out of step with federal, state and local government’s upbeat statements, according to government officials and economic commentators with knowledge of the matter.

George Hartzman, who has been outspoken about rising corporate and government debt, the real estate market and crony capitalism in Greensboro, North Carolina received a warning in recent weeks, these people said.  It was at least his second. The first came from the Securities Exchange Commission, and the later one, these people said, from North Carolina's Treasurer's office, which instructed him to avoid making “overly bearish” remarks about the economy, particularly investment fees in the state's retirement plans and commercial real estate.

At least one local non-profit foundation was told by City of Greensboro and State officials not to cast doubt on a planned government program to build a megasite in Randolph County involving the state owned North Carolina Railroad, which is refusing public information requests.

Hartzman has told investors that “a lot of official data aren’t reliable” and the economy still faces “big problems,” according to people who attended the closed-door event.

Words of those remarks crackled across social media.

Hartzman and representatives at his firm didn’t return requests for comment, as his name is virtually banned from appearing within local papers and other news outlets.

While restrictions on economic related media have always been tight, they are becoming tighter, with a growing list of publications receiving pressure to produce calming narratives including Greensboro's News and Record, the Triad Business Journal and the Rhino Times.

George Hartzman Files Amicus Brief

Today, at 1:55 PM, George Hartzman filed a Motion For Leave To File Amicus Brief in the United States District Court For the Middle District Of North Carolina Civil Action No. 1:15-CV-559 in Greensboro. Attorneys for the plaintiffs have been informed as have the court.

It is the belief of Mr Hartzman that concerning HB 263 that the plaintiffs have misrepresented the facts, as Mr Hartzman points out in his Amicus Brief which was also filed today.

I do not typically get involved in local politics because the weight of the spin as it lines the pockets of bed partners crushes my spirit. As we walk our dogs I will complain and whine about what I see of SOME self serving city council members past present and future and the power of money and ego and greed. 

I bemoan the tracks of the heels dug in so deep by the few who wield the power to resist making the very change that can make a difference for most. After listening and even sometimes agreeing he ALWAYS says "that doesn't mean you stop fighting ." 

George Hartzman I'm done trying to keep you out of the ring. 

After ALL of these years you are consistent in your glass half full attitude and I do believe this city could benefit from drinking out of that glass- best of luck to you sir!!"

Redux: Who would be stupid enough to spend $22.5 million to get water and sewer to a Megasite, about 10 miles away from another that already has it?

George Hartzman has a most excellent post regarding the close proximity of the Chatham-Randolph mega site, a completed mega site, and the Greensboro-Randolph fledgling mega site. One should consider visiting the post as it includes plenty of useful data and links:

Yes, no one would be that stupid, which is likely Mr. Hartzman’s point. Meaning, "stupidity" is not the cause for expending $22.5 million.

One can clearly state, with great certainty, that the deployment of $22.5 million to a fledgling mega site, roughly 10 miles from a completed mega site, has nothing to do with free markets or capitalism. That is, capitalism is much different than "rich-friendly legislation" -or- "politicos through the mechanism of government granting privilege".

Win, lose or draw someone will make money at the expense of taxpayers. The only "failure" possible, is for the taxpayer to fail.

Better yet, say there really is one elusive auto assembly plant out there. The more empty mega sites the better for the rent-seekers of the elusive auto assembly plant. Is it better to have 180 empty mega sites or 181 empty mega sites if you are the elusive auto assembly plant? 181 of course!

Putting the above observations into an action phase: Elusive auto assembly plant X finally strikes its colors and becomes a known-known looking for a location. Beyond the taxpayer funded resources already sunk into many of the 181 mega sites, X can now demand a premium price to locate as only one winner will emerge and 180 empties will remain.


Taxpayer money will be ramped up as the sweetener with the final winner really being the final loser regarding the taxpayer. The taxpayers associated with the remaining 180 empty sites being losers as well.

Regardless of the 181 taxpayer losers, select and particular winners will emerge, at taxpayer expense.

Last night before the Greensboro City Council, George Hartzman and I proposed a resolution to the problem at Heritage House that would restore properties to their rightful owners, allow landlords out of the burden of City regulations and restore the Heritage House Community to better than ever before. Local politricksters aren't likely to want to read it but Greensboro's own political blogger George Hartzman  is now making news state wide as his ethics complaint against Senator Phil Berger Sr picks up steam.  

What's really groovy about this is that beginning in 2015, many of the same ethics rules that apply at the state level will also apply at the local level giving Team Hartzman and Jones a new tool in the battle against corruption at the local level. You see, George writes it up, I notarize it and the complaint is filed easy-pezy.

That's right, the Greensboro City Council might be able to ignore George Hartzman and myself but if they ignore the State Ethics Board it's fines and jail time.

Bet they didn't see that coming.

Ethics Complaint Filed Against Phil Berger Sr

George Hartzman of Greensboro, North Carolina has filed an ethics complaint against President Pro Tempore of the North Carolina Senate, Phil Berger Sr on behalf of the citizens of North Carolina relative to Senate Bill as passed by the Senate in July 2014. The controversial bill is currently awaiting signing by Governor Pat McCrory


The bill is said to personally benefit Senator Berger's son, Phil Berger Jr and Paul Norcross, Chief Political Adviser to Phil Berger Jr in the formation of charter schools.

Mike Barber Swings At The End Of George Hartzman's Rope

Yesterday Jeff Martin published an e-mail from Greensboro City Councilman Mile Barber to George Hartzman. In that letter Councilman Barber accused George Hartzman of being drunk at a Greensboro City Council meeting. In it Mike attacked George Hartzman:

"George, I know why you are doing this. About 4 meetings ago you were drunk and passed out in the council chambers. I had Officer Franks go wake you, walk you out, and tell you that you could not continue to come to meetings drunk, and leave, drink, and come back. But I also ask him to make sure you didn’t drive, offer you a ride home, and try to insure you avoided arrest.

You think I embarrassed you but I think I did you and your family a favor.

I texted you that night after the meeting to make sure you got home and you did respond. It’s unlikely you will share your response, I also said in my text ” You’re hurting your family, others and yourself.”

There are a couple of things everyone needs to know. I started this-- not George. I'm the one who e-mailed Jeffery Sykes of Yes Weekly along with George and others to put them on Mike Barber's trail after I got a package from a reader. To imply that George was doing this as revenge-- as a group Greensboro's bloggers have been going after local politicians for years, my thinking was that if Jeff Sykes, the editor of Yes Weekly were to lead with the story it would get more traction and be less likely to be ignored by Mr Barber as City Council is in the habit of simply ignoring Greensboro's bloggers and trying to pass us all off as a bunch of idiots.

Well who is looking like an idiot now Mr 7% of the money your "non profit" takes in actually goes to charity?

The other thing Mike probably doesn't want you to know is that e-mail wasn't just sent to George Hartzman. It was in-fact sent to George Hartzman, Roch Smith Jr, Joe Guarino, Eric Robert, Jeff Martin, myself and possibly more in what I perceived to be a deliberate attempt to smear Mr Hartzman.

And I'm willing to testify to that in court.

Mike Barber is a lawyer, good lawyers don't misspeak-- ever.. Like too many on the power trips with the City of Greensboro, Mike tried to scare us away with a bluff. Didn't work. Former Greensboro City attorney S Mujeeb Shah-Khan tried bluffing us. He's a lawyer and he no longer has a job with the City of Greensboro. Not only did Mike lie about being subsidized by the City of Greensboro and failed to address every issue we brought up, Mike opened himself up to a possible lawsuit with that e-mail and with everything else we've already proven, George has a very good chance of winning the suit. You see, even if the officer testifies that George was drunk at a city council meeting Mike made no mention of a breathalyzer test and says the officer took George Hartzman home. No breathalyzer test? No medical treatment? George could have been having a seizure. Or a stroke. I had a stroke at 46, how old is George? The symptoms of a stroke include impaired motor skills, slurred speech and blurred vision-- sounds like a drunk to me. George's life could have been at stake. Or he could have simply been so tired he fell asleep. We don't know because Mike Barber, a lawyer and officer of the court, by his own written admission, mishandled the entire situation just like he's mishandled First Tee of the Triad and his position on the Greensboro City Council.

And Mike Barber knows I'm right. So much so that he'll no longer discuss the matter for fear anything he says might be used against him in a court of law. No Mike Barber is hurting his family, his self and others-- thousands upon thousands of others.

Mike Barber put the noose around his own neck and if George wants to tighten it, Mike swings high. Mike had better hope George is bigger on forgiving than I am.

And folks, this is far from over, we've more on Mike Barber we've yet to publish and ropes at the ready for other Greensboro City Council members. The corruption, be it on the left or the right, will end.

GPAC: True Or False?

"The City of Greensboro’s finance department has not underwritten, reviewed or signed off on the legally binding donor commitments, the potential taxpayer liability above the $30 million City Council authorized for the performing arts center, the private sector lending agreement, a time line of how much of the $35,448,920 is supposed to appear and when, the statistical likelihood of how much of the $35,448,920 in pledges may or may not appear or hypothetical asset return projections concerning the $35,448,920 in private pledges.

If I don’t hear back, I will assume all of the above is correct.

Is it wrong to expect politicians to answer questions before they commit to spending tens of millions of dollars of taxpayers' money? Somehow I just don't believe ignoring Mr Hartzman's questions is an acceptable answer.

The Greensboro Elites Absolute Worst Nightmare

Old timers may remember some years back when John Hammer of the Rhino Times announced his write-in candidacy for mayor of Greensboro in his weekly column just 3 weeks before the election and nearly won the election. It was apparent to everyone that an announcement just one or two weeks earlier would have pushed John well over the top and toppled Greensboro's elite political structure. To this day, every mayoral race that comes about there are still write-in votes for John Hammer.

John never ran again because he never really wanted to become Mayor of Greensboro. John wanted to run a newspaper instead.

But what if John had run again? Greensboro might or might not be a very different city than it is today. Either way, corrupt empires would have been toppled.

Since that year Greensboro's elites have always lived with the fear that someone from outside their closed ranks with the name recognition of say, a John Hammer, might run for Mayor or some other seat on Greensboro City Council. For you see, it has long been known that name recognition is the #1 means by which candidates get elected to local office. As I have said so many times before, "He with the most yard signs wins."

But there is something bigger than yard signs, something bigger than endorsements in blogs and local newspapers, bigger than interviews on television. John Hammer hit on it years ago and yesterday George Hartzman hit on it too with his first weekly column in Yes-Weekly entitled, On Greensboro’s Civil Rights Museum.

If George Hartzman decides to run for mayor again the elites will fall.

Greensboro Looses $1 Million Dollars And Hides Evidence

As George Hartzman reported on January 11, 2014,  the City of Greensboro Comprehensive Annual Financial Report listed the Total Fair Value of the City Investment Portfolio. aka, the Rainy Day Fund as being $272,083,730.  George also pointed out that the  Total Fair Value of the City Investment Portfolio in 2012 was $1 Million dollars higher than 2013.

I suggested in a post on my blog that then Mayor Robbie Perkins had used the money to pay off personal debts and thousands of dollars in IRS leans after testifying in court that he had no money for child support and alimony. Of course I wasn't really serious but something amazing then happened: Someone hacked into my blog and removed that very post. I was notified by Blogger.com that someone else was logging in and out of my blog from another location but it wasn't until I went searching for that January 17th post that I discovered it missing.

You see, on Janurary 17th, just minutes after I posted my comments concerning Robbie Perkins, George Hartzman included me on the following Public Information Request:

I'm sure the disabled link will work again soon. Will the documents be doctored? Don't forget there are those of us who have already downloaded the original 321 page document. Wouldn't want to compound your problems, would you?

I've since enable 2 stage log-in of my blog. Anytime someone tries to log-in Blogger.com gives my cell phone an automated call with a newly generated 6 digit code that must first be entered. Consider yourself fucked, Mr Perkins.

Nancy Vaughan Could And Should Do More

In today's News & Record, George Hartzman writes:

"Mayor Nancy Vaughan has asked Greensboro’s City Council to adopt more transparent ethics disclosures for some very good reasons.

For example, at the Dec. 17 City Council meeting, Nancy Hoffmann nominated her business partner, Nick Piornack, to Downtown Greensboro Inc.’s board, after voting to loan Piornack’s firm $200,000 for a parking lot that created spots where patrons of her three recently purchased buildings will likely park for a fee.

Hoffmann also nominated the architect for her now-taxpayer-subsidized project at 304 S. Elm via a DGI grant, which city taxpayers funded via a Hoffmann City Council vote. The interior designer for the same property now serves on the Minimum Housing Standards Commission.

If council members place citizens who do business with them on city boards, they should disclose the connections. Members should disclose financial interests in businesses and nonprofits, as well as organizations they are involved with that may become reliant on City Council votes bequeathing everyone else’s money.

Even though participation would be voluntary, identifying and following the actions of those who choose not to provide sunlight on their financial dealings should be enlightening."

Problem is: Mauor Vaughan's new disclosure rules won's stop Councilwoman Hoffman from lying or force her to disclose her associations. Case in point: Council members are already required to disclose all property they own to the City staff and voters but back in 2012 when I pointed out that Nancy Hoffmann had intentionally hidden her purchase of  304 S. Elm, the same building Mr Hartzman writes of in his letter to the editor, Greensboro City Councilwoman Nancy Hoffmann faced zero consequences.

On November 16, 2012, Greensboro City Attorney S Mhjeeb Shah-Khan wrote a letter (PDF) to the City Council defending Councilwoman Hoffman of my charges. Time has proven the city attorney to be wrong-- again.

You see, I spoke on the telephone with Frayda Bluestein of the North Carolina School of Government back in December of 2012 when I penned The Plight Of Local Governance and it was with tears in my eyes that I wrote:

"Recently I wrote of my concerns that Council members Zack Matheney and Nancy Hoffman had not filed their property disclosure forms as is required by Greensboro City Law only to find out from the Greensboro City Attorney that property disclosures are not required by Greensboro City Law. Well, they are required but they're not required.

You see, there is no penalty, no loss of voting privileges, no fines, no fees, no nothing that can be done to a council person who breaks any council rule imposed by City Council.

I didn't believe it either. I thought the City Attorney was playing me for a dumb redneck so I contacted the North Carolina School of Government to find out. The NC School of Government agreed. When they returned my call yesterday just minutes before I rushed out to get an early place in line at last night's Greensboro City Council meeting, the experts from the SOG explained to me that while all local governments in North Carolina have the right to pass laws regulating their own conduct, none have authority to establish or impose penalties upon members of their  own boards.

Sadly, this is why it is impossible for the Greensboro City Council to police itself and any effort to impose self-regulation no matter how well intentioned, is merely a farce. This is why the rich will always control our local governments. This is why the poor will always suffer at their hands."

Nancy Baracat Vaughan can and should do better. Instead of wasting Council's and staff time drafting and passing feel good resolutions that will not be obeyed and have no means of enforcement, Mayor Vaughan should be asking the Greensboro City Council to pass a resolution to lobby the North Carolina House and Senate to enact laws with teeth-- laws that can and will be enforced.

But Nancy Baracat Vaughan, who first ran for city council on a platform of ending local corruption only wants to put up more smoke and mirrors-- why?

If you can't do something the right way then don't do it at all.

Merry Christmas To Greensboro From Koury Corporation!

With the help of Greensboro City Manager, Denise Turner Roth and then Assistant City Manager Andy Scott, Koury Corporation ripped-off Greensboro taxpayers for a total of $215,116.36 despite the fact that documents provided by the City of Greensboro  indicate the problem was not the responsibility of the City of Greensboro.

George Hartzman has the entire story and the cover-up that followed. Heads should roll.

Low Cost Competition For Downtown Greensboro Hotels Without The Need For Incentives

George Hartzman points us to Airbnb a company that allows homeowners and apartment owners to compete with hotel chains world wide at lower cost providing all the comforts of home without all the hassles of checking into hotels or the downtown parking problems. George writes: 

"A new 3,000 seat performing arts center in Downtown Greensboro during what looks like to be a deep recession may spawn local vacant property listings to be utilized for consistent downtown patron accommodations within a $5 cab ride of downtown.

Feels like there will also be some bed and breakfast facilities opening up upon completion of the GPAC, that may have to compete with what may be local government subsidized hotels.

If so, our local elected leadership may indirectly stifle small business and entrepreneurship growth by rewarding their campaign contributors with some of everyone else's money, even as the business model for hotel rooms morphs into another realm.

If Greensboro builds the GPAC, which looks shaky if financial markets correct and some of the monies pledged don't/can't materialize, our community should support small business over entrenched elites trying to skim higher profits off their ownership of downtown properties at the expense of everyone else."

"If the newly installed city council doesn't take some kind of control, they will be found to be at fault, even though the process was begun by a previous administration.

If some businesses are propped up with taxpayer money at the expense of others in the process, the current city council should be held to account, for they will have violated the concept of free market capitalism in Greensboro."

Why Aren't Media PIRTs Included On The List

Are local bloggers and citizens the only ones asking the City of Greensboro for Public Information Requests? It would appear that way if you look at the weekly IFYI but we all know local media outlets also submit and get PIRTs from the City Of Greensboro on a regular basis but as George Hartsman points out, media requests aren't showing up on the list.

Case in point: The WFMY-2 story that pointed out that Kingsgate South Apartments is 4 years behind on mortgage payments to the City of Greensboro.

It's time the corrupt political favors ended.
