Allen Johnson's deafening silence on N.C. Treasurer Folwell's plan to increase transparency and lower healthcare costs

State Treasurer Dale Folwell was in New Bern Tuesday to outline the Clear Pricing Project, a plan to keep North Carolina’s State Health Plan solvent beyond its projected fiscal lifespan. At current spending levels of nearly $3.3 billion per year, the plan is projected to run out of money in 2023.

...According to Folwell, the Clear Pricing Project, which would begin January 1, 2020, is an effort to change how doctors and hospitals are reimbursed under the State Health Plan. He said the proposal would save taxpayers $258 million annually and plan members $57 million in out-of-pocket expenses. On average, health care providers would be reimbursed for their services at Medicare rates plus an average of 82 percent. The State Health Plan Board of Trustees has unanimously approved the Clear Pricing Project.

According to Folwell, the N.C. State Health Plan has one of the lowest participation rates of any plan its size.

...The Clear Pricing Project has met resistance in the N.C. General Assembly. Earlier this month, the state House voted 75-36 to create a special panel that would study how to realign the State Health Plan. The move would essentially block Folwell from implementing changes to the current provider reimbursement system...

“Right now, a starting teacher or trooper has to work one week out of every work month just to afford the family premium for health care,” said Folwell. “The current plan is unsustainable. Whether it’s the Governor’s budget or the General Assembly’s budget, the increased money we get is 4 percent a year and our health care costs are going up more than that and our prescription drugs are double digit.”

Folwell explained that ...its auditors “do not have access to the contracts and cannot verify that the State Health Plan is receiving the proper contractual discounts.′

...Folwell said a public records request his office made for medical procedure price lists from UNC Health Care provided only reams of redacted pages.

...The North Carolina Healthcare Association, which represents hospitals, has also come out against the Clear Pricing Project. President Steve Lawler has characterized the plan as an “approach to just reduce rates, versus an approach to improve people’s health, improve the health of communities.”...

...“We have some providers, not hospitals, that are charging 700 to 800 percent of Medicare right now.”

The State Employees Association is “100 percent” behind the Clear Pricing Project proposal, said Folwell.

Allen Johnson let Cone Health run an opinion piece on keeping the con in place by the CEO, but has yet to write anything himself on the subject;

Rep Faircloth Files Bill To Force Greensboro To Change Its Evil Ways

But here in Greensboro, the Greensboro City Council has a long history of providing incentives to developers to build new properties and expand the city limits while continuing to ignore these empty properties, allowing them to become eyesores, centers for crime, and a drain on our economic development while they continue to fatten the wallets of connected developers.

Of course, I worry about the particulars and the potential for abuse this bill may produce. Or the favoritism the city might show in enforcing it. For example: Roy Carroll and Marty Kotis, who have both received incentives to build outside the city limits, own properties that could be taken under this new law but will Kotis and Carroll instead be chosen as receivers for properties taken from other property owners who are not as connected as they are?


Is Faircloth's bill a solution to our problems or simply another means of redistribution of wealth?

Roy Carroll, John Hammer, Jon Hardister, John Faircloth, John Blust and Trudy Wade confirm they are bigots

As "More HB2 Misrepresentations", by Roy Carroll's Rhino Times states, what the News and Record is saying in "Our Opinion: Find the way out", our local state legislators are saying isn't true. We have elected bigots to represent us.

The saddest part of this whole affair other than lost jobs is the News and Record and other 'mainstream paper's overtly purposeful inability to call out those business leaders supporting the economic decimation of our state. Roy Carroll and other funders of these elected officials are advocating bigotry, discrimination and fewer worker rights in North Carolina, and the news industry isn't pointing out who the real villains actually are behind the curtain.

Consumers who could be objecting with their wallets are being prevented from the opportunity to do so.  Marty Kotis just hosted a John Blust fundraiser at one of his restaurants.  He supports Phil Berger and the rest of our local delegation.  He serves on the UNC Board of Directors as an R.  Marty supports HB2 and is going to make more money from it by being able to fire pregnant women etc... and no one seems to want to point it out.

Our community can't get this fixed unless more than a few actually know what's going on.

"...HB2 had four primary sponsors, all Republicans, and ahead of McCrory’s Tuesday announcement, the most vocal of those, Rep. Dan Bishop of Mecklenburg County, did not return calls inquiring about who pushed for that provision.

Rep. Bob Steinburg also did not respond to inquiries, but Rep. Julia Howard, of Davie and Forsyth counties, said the language was crafted by state lawmakers.

“There were eight of us that worked on the House side and there were I think eight that worked on the Senate side,” Howard said. “It was just a collaboration of the eight members from the House, eight from the Senate that pulled the language together.”

Another sponsor, Rep. Paul Stam, of Wake County, said he knew “a lot of the source of the bill, but not the source of that one sentence.”...

...What is technically true and what is pragmatic for a fired employee bringing suit on a race-discrimination claim don’t move in lockstep.

Under the current law ushered in by HB2, employees can still file a claim at their county courthouse under the federal law, “but no employer would ever leave that federal statutory claim in state court,” Clarke said.

They would request to have it removed to federal court, a legal maneuver that gives them a financial edge, Clarke said. Federal cases are more costly, and a company that has both cash flow and insurance isn’t facing the financial pinch of an employee who might be jobless and feeding a family.

“It sends a really bad message about who we are,” Clarke said. “North Carolina’s the first state to eliminate these basic discrimination rights under state law, which is a pretty ugly distinction, and now we’re only the second state with Mississippi to not have workplace protections under state law on these fundamental categories.”

Fired employees can also seek federal discrimination protections through the Equal Employment Opportunity Commission, but those claims must be filed within 180 days, as opposed to the three years formerly allowed under North Carolina statute.

In fiscal year 2014, about 4,000 people filed a claim though the EEOC in North Carolina, but it’s not practical for many employees, said Eric Doggett, an employment attorney and chairperson of the North Carolina Advocates for Justice, an organization of legal professionals that seeks to protect rights for people.

Workplace discrimination is often just the beginning of a series of traumas, he said, and the six-month federal time frame isn’t always enough time for a potential plaintiff to begin legal action.

“They get fired, they get walked out the door, and they get traumatized again because they have no income. They try to get unemployment, but the employer fights unemployment and they are going through the fight and appeals to get their unemployment pay,” he said. “They’re trying to feed their kids. They got cut off from medical benefits. As they’re dealing with all these things, they have 180 days to file their claims with the EEOC, or they lose their federal claims forever. A lot of people don’t understand they have to do it, and it doesn’t become important to them until they need it.”

The venues are also far-flung. The 19 westernmost counties, for example, are served by one federal courthouse, which is in Asheville.

Some fired employees might not realize they have a discrimination claim until after the federal window has closed, said Asheville employment attorney Jessica Leaven.

An older employee or a pregnant woman might not know they were replaced by a younger worker or one without a newborn until that window has closed, shuttering them from discrimination claims..."

"Governor Pat McCrory’s Executive Order 93 doesn’t fix or even put a band aid on HB 2." Meaning Pat McCrory lied to the public on March 25, 2016

"Executive Order 93 shows that McCrory was not truthful back on March 25, 2016, when he posed and answered this question: “Does this bill [HB 2] take away existing protections for individuals in North Carolina? Answer: No. In fact, for the first time in state history, this law establishes a statewide anti-discrimination policy in North Carolina which is tougher than the federal government’s.” At least until he pulls it down, this series of questions can be found here. In Executive Order 93, however, McCrory now admits this was not true: “I support and encourage the General Assembly to take all necessary steps to restore a State cause of action for wrongful discharge based on unlawful employment discrimination.”

..."The non-discrimination policies in place today in cities like Raleigh, Greensboro and Asheville and in every business in North Carolina are the same as they were last month and last year.”

...Executive Order 93 now also sees the need to step in and “affirm that private businesses, nonprofit employers and local governments may establish their own non-discrimination employment policies.”

...holding out an Executive Order as even capable of modifying contrary positions of legislation is deception of the worst sort. McCrory’s role was to veto HB 2 which he did not do. We live in a democracy where the executive branch doesn’t have dictatorial powers over the legislative branch. Where HB 2 prohibits it, the governor can’t simply change the law stripping power from local authorities by simply affirming for example that “local governments may establish their own non-discrimination employment policies.”

...The Executive Order also provides: “Nothing in this section shall be interpreted as an abrogation of any requirements otherwise imposed by applicable federal or state laws or regulations.”

One of the least discussed aspects of the state’s new discrimination law is the fact that is strikes down an employee’s right to sue a company for wrongful termination.

Rick Copeland is in his 60s and was fired last March from his job as a vice president at BB&T’s office in Gastonia.

“I was the oldest guy making the most money,” Compton said.

...Compton filed a discrimination complaint with the U.S. Equal Employment Opportunity Commission.

...“It was purely an age discrimination case,” he says.

But now with HB2, Compton can no longer file suit in state court.

HB2 strips terminated employees’ rights to sue their former employer for discrimination  and wrongful termination claims based on protected class including race, religion, color, national origin, age, sex and handicap.

...the vast majority of lawyers in North Carolina have never appeared in a federal court and do not understand the steps you must take to bring and win a federal discrimination claim. As a practical matter, many North Carolinians will not be able to fight against discriminatory firings.

...attorneys representing North Carolina citizens in employment cases within the federal system must wait until EEOC investigations complete (a requirement not present in the state system). The EEOC process can take anywhere from six months to two years to complete.

North Carolina may have successfully legislated a solution to a problem that didn’t exist (as no sexual assaults have ever occurred in any of the 200+ local governments with transgender protections for decades where the assailant was transgender or used trans-inclusive laws to attack women or children), but it effectively crippled itself economically in the process.

Whether it’s the millions in business the state is hemorrhaging daily or the legal limbo it gleefully placed its citizens in to placate corporate interests, North Carolina now stands as a shining beacon of far right Republican leadership and governance."

...How do we evaluate potential threats now that HB2 is the law? There's a guy in the women's restroom, do we call the cops to see if he is transgender man merely complying with the law or are we less able to assess real potential threats because HB2 requires certain people who look like men to use women's facilities?

For those who truly worry about privacy and security in bathrooms, Berger and his HB2 supporters haven't made you any safer, they have given you a false sense of security, but if you think it through, they have actually made bathrooms less safe—for everybody.

...If it were truly a threat to public safety to allow transgender people to use bathrooms that match their appearance, as Charlotte would have allowed, how could Berger have been so derelict and so irresponsible as to only apply the provisions of HB 2 to government bathrooms? "They are elected officials who wreaked havoc on innocent lives by uncaring, unfeeling, selfish, irresponsible, parasitic psychopaths who lie to their constituents, trade political favors for campaign contributions, turn a blind eye to the wishes of the electorate, cheat taxpayers out of hard-earned dollars, favor the corporate elite and spare little thought for the impact of their thoughtless actions and hastily passed legislation might have on defenseless citizens.

Pat McCrory, Phil Berger, Jon Hardister, John Faircloth, John Blust and Trudy Wade have a tendency to be selfish, callous, remorseless users of others, irresponsible, pathological liars, glib, con artists, lacking in remorse and shallow.

We are fast becoming slaves in thrall to a government machine that relentlessly erodes our freedoms through countless laws, statutes, and prohibitions.

Any resistance to such regimes depends on the strength of opinions in the minds of those who choose to fight back. What this means is that we the citizenry must be very careful that we are not manipulated into marching in lockstep with an oppressive regime.
