Formal Complaint Alleges Systemic Conflicts of Interest at The Assembly, DGI, and CFGG

GREENSBORO, N.C. June 28, 2025 — A detailed formal complaint filed by government watchdog George Hartzman accuses The Assembly, a North Carolina-based news outlet, of systemic conflicts of interest involving its Greensboro coverage, funders, and local institutions including Downtown Greensboro Inc. (DGI) and the Community Foundation of Greater Greensboro (CFGG).

The complaint names The Assembly’s Greensboro editor Joe Killian, his wife Amanda Lehmert Killian, and multiple institutions whose financial and professional entanglements allegedly compromise the outlet’s ability to report independently on local government and economic power players.

Allegations of Conflict: Marriage, Money, and Media

At the heart of the complaint is Joe Killian, a veteran journalist who previously worked for the News & Record. Killian is married to Amanda Lehmert Killian, who served as a Senior Communications Specialist for the City of Greensboro for eight years under Mayor Nancy Vaughan, who served on DGI's board of directors. Amandda also held a leadership position with the Guilford Green Foundation while Vaughan was Executive Director, a nonprofit that received a $2,500 sponsorship from DGI earlier this year, paid via CEO Zack Matheny’s taxpayer funded credit card.

DGI used taxpayer funds to provide gifts and favors to public officials and contractors, potentially violating N.C. Gen. Stat. § 133-32 (gifts and favors regulated) and N.C. Gen. Stat. § 138A-32 (State Ethics Act). These gifts were not reported, suggesting willful concealment and potential violations of 18 U.S.C. § 201 (federal bribery) and N.C. Gen. Stat. § 14-217 (state bribery).

Hartzman argues that these connections, combined with Killian’s relationships with city officials and prior affiliations with open government groups, create an environment ripe for bias—one in which scrutiny of DGI and city government is systematically avoided.

A Closed Loop of Influence?

More broadly, the complaint paints a troubling picture of a media ecosystem influenced by those it’s supposed to cover. The Assembly receives funding through the Greensboro Community Journalism Fund, hosted by CFGG. CFGG itself is a financial partner of DGI and is led by Walker Sanders, who appears on DGI’s internal expense records as the recipient of multiple meals purchased with public funds.

According to the 23-24 DGI ledger obtained by Hartzman on May 21, 2025, Matheny’s DGI credit cards were used three times between August 2023 and February 2024 to purchase meals labeled as meetings with Sanders—totaling $279.24. Meanwhile, CFGG funds both DGI and The Assembly's Greensboro coverage, raising serious concerns about journalistic independence and potential “excess benefit transactions” under IRS rules for nonprofits.

“This isn’t journalism, it’s a closed loop of mutual backscratching,” said Hartzman.

“Taxpayer money flows to DGI. DGI spends it on influencers like Sanders. Sanders' network funds The Assembly, and then The Assembly runs interference for DGI. The public is left misinformed.”

DGI’s expenditures, funded by city contracts, include questionable uses of taxpayer money, potentially constituting N.C. Gen. Stat. § 14-90 (embezzlement of public funds) and IRS Private Benefit Doctrine violations for 501(c)(6) organizations.

Questionable Reporting and Correction Requests

Hartzman also accuses The Assembly of misrepresentation and failure to meet basic journalistic standards in its coverage of his efforts to uncover irregularities at DGI. He specifically takes issue with statements in Joe Killian’s June 2025 article, “A Conflict Over Conflicts,” including a claim that “none of that was true” in reference to emerging allegations against DGI.

“That conclusion is not supported by facts and presumes the outcome of an unresolved situation,” Hartzman wrote in a June 27 letter to The Assembly. “The financial records are real. The program existed in secret. The lack of accountability is evident.”

Further, he alleges that The Assembly’s reporter Gale Melcher failed to contact him for comment despite referencing him directly in a recent article about DGI’s controversial homeless relocation program involving Greyhound bus tickets. Records show that 32 ticket purchases were made using DGI’s credit card—before the program had any public oversight.

Institutional Silence, Public Trust Eroded

Hartzman argues that The Assembly’s refusal to acknowledge or correct these issues is part of a broader pattern of journalism serving power rather than holding it accountable.

“This is how power protects itself—by attacking those who ask questions, dismissing evidence without examination, and manufacturing narratives to discredit critics,” he wrote.

The complaint also highlights The Assembly’s founder, Kyle Villemain, and his background in strategic communications. Hartzman argues that Villemain’s dependence on maintaining relationships with North Carolina’s nonprofit and political elites further undermines the outlet’s claim to editorial independence.

Demands for Accountability

Hartzman is requesting formal corrections to past reporting, transparency about funding sources, and a commitment from The Assembly to avoid conflicts of interest in its coverage of DGI, CFGG, and Greensboro’s city government.

The Assembly has not yet publicly responded to the complaint.

Hartzman says he has filed formal complaints with the City of Greensboro, The State Ethics Commission, Auditor, Local Government Commission, North Carolina Secretary of State’s Lobbying Compliance Division, IRS and FBI regarding the DGI ledger and related issues. He maintains that watchdog efforts like his are essential when traditional journalism fails.

“The public deserves better than sanitized press releases masquerading as news,” he said. “We need a press that investigates, not one that protects the powerful.”

In a Feb. 29, 2016, interview on CNBC, Buffett said Stumpf had done “a fabulous job” and that Buffett himself would “have a hunger strike in front of the directors” of Wells Fargo if they went along with the CEO’s idea of retiring in two years at age 65. “It’s a very well-run bank,” Buffett said on CNBC in February.

This was only the most recent in 25 years worth of examples of Buffett touting Wells Fargo. In his March 1991 Berkshire shareholder letter, Buffett described Wells Fargo as “superbly-managed.” In his March 7, 1995, shareholder letter, Buffett described Wells Fargo as “Berkshire Bank.”

In his Feb. 28, 2006, letter to Berkshire shareholders, Buffett reported, “we substantially increased our holdings in Wells Fargo, a company that Dick Kovacevich runs brilliantly.” It was in 2005 that, according to The New York Times, employees at Wells Fargo started making internal complaints about the sham accounts.

On Feb. 25, 2012, Buffett told Berkshire shareholders that he’d spent another $1 billion buying more of Wells Fargo, describing the holding as among a few “partnership interests in wonderful businesses.” On Feb. 28, 2014, Buffett told Berkshire shareholders that Berkshire had bought even more Wells Fargo stock, calling it a “wonderful company” and comparing it to the Hope diamond.

In Buffett’s letter to Berkshire shareholders in 2015, he reported that “four horses pulling a Wells Fargo stagecoach” would appear in Omaha, Neb., for the Berkshire Hathaway annual shareholder meeting. It was a physical symbol of how closely Buffett and Berkshire were publicly and proudly identified with the bank that is by far its largest public stock position.

Buffett didn’t buy Wells Fargo stock for only Berkshire Hathaway; he also bought some for his personal account — more than 2 million shares, or about $100 million worth, depending on the stock price, according to a recent disclosure. How Buffett handles the potential conflicts of owning shares personally and also for Berkshire is another matter that might be of interest to Sen. Warren. Buffett and Berkshire together were by far the bank’s largest shareholders, with a combined stake exceeding 10 percent.

...Buffett has been a reliable proponent of tax increases that would have no material effect on him but would make things more expensive for his competitors.

Until and unless you hear Obama, Clinton and Warren criticizing Buffett as much or more as they castigate Stumpf, recognize their bank-bashing for what it is: political posturing and selective outrage, rather than principled, rules-based oversight."

City Offers 2016 Bond Referenda Educational Materials and Speakers

GREENSBORO, NC (August 29, 2016) – The City of Greensboro is offering a variety of educational materials and speakers to help residents understand the bond referenda that will be on the ballot November 8.

Greensboro voters will decide whether to let the City borrow $126 million to pay for a variety of projects and programs. They will vote “yes” or “no” on four separate measures: $38.5 million in community and economic development bonds, $34.5 million in parks and recreation bonds, $28 million in transportation bonds, and $25 million in housing bonds. Early voting begins Oct. 20.

The City website contains detailed information about the referenda, including what projects and programs will be funded if voters approve the measures. Visit www.greensboro-nc.gov/2016bonds to review the information. Printed materials will also be available at recreation centers and other City facilities as of September 1.

Amanda Lehmert and Joe Killian

"For years local government had been covered by a husband and wife team at the News & Record.  Amanda Lehmert covered the city government and her husband Joe Killian covered the Guilford County government.  Then Amanda started covering the state government and Joe moved across the governmental plaza to cover the city.   In the spring of 2015, Amanda left the News & Record to work for a marketing company.  Then, this summer, Amanda started working for the marketing and communications department of Greensboro and Joe was sent to Raleigh to cover state government.

To no one's surprise, it was announced this week that Joe Killian had left the News & Record and will be working for the North Carolina Justice Center.  So it seems the pattern is city government, state government and then out the door."

Heard Spice Cantina went under...along with a couple hundred thousand Greensboro taxpayer dollars

"A property south of the train tracks behind South Elm Street and the Cascade Saloon was sold in 2008 to what would become Greensboro Parking Group LLC for $1,050,000, with a $52,500 real estate commission, half of which was paid to “NAI”.

In February 2012, Greensboro’s City Council passed a resolution approving a $200,000 loan, $100,000 of which was to construct a parking lot that has been completed, and a second $100,000 for a companion restaurant to Worx. Current City Council members who voted for the loan include Nancy Hoffmann, Yvonne Johnson, Zack Matheny, Nancy Vaughan and Marikay Abuzuaiter.

This is on Nancy, Yvonne, Zack, Nancy and Marikay's heads.

These current City Council Members

are directly responsible for what took place

The developer agreed to, and was required to comply with, specified contractual conditions including; “The second $100,000 of City loan funds will be invested in the last $100,000 of project improvements after confirmation that the developer equity and bank funds have been fully deployed into the project. Architect’s or engineer’s certification of work completed on the project and work remaining to be done will be provided to the City prior to the release of any City loan funds. Committed funds totaling $2,272,860... Capital investment must be complete and in-place by July 31, 2013. The parking lot and restaurant tenant, [Spice] Cantina, are required to create at least 4 new full-time positions [by] July 31, 2013. Developer must confirm that all funds inclusive of the tenant up-fit funds of $179,000 necessary to open the restaurant are available and ready to be invested in the business and present a signed lease ... that will own and operate [Spice] Cantina before the second $100,000 of City loan funds are disbursed. The second $100,000 will be used in the renovation and opening of the restaurant and will be reimbursed ... only after all work is substantially completed on the project. The second $100,000 of City loan funds will be invested in the last $100,000 of project improvements after ... bank funds have been fully deployed into the project. No advance payments shall be made.”

Instead of letting organic  forces of free market capitalism

A member of the Momentum Group, whose principals including Downtown Greensboro Inc. (DGI) board member Nick Piornack, informed three City staff members last week that “75 or 80 percent” of the Cantina was complete.

Previously, Hoffmann consented to allow a tenant to apply for a retail grant for her Elm Street building for electrical work, frame and sheet rock, and plumbing. In my view, the grant, which was funded by a Hoffmann Council vote that allocated monies to DGI, benefited her personal property. At a Council meeting, Hoffmann stated “No taxpayer money was spent on my behalf for the 302/304 South Elm building.”

It appears the developers have not deployed the agreed upon private monies before asking for the second $100,000 as required. The capital investment and jobs were not in place by the deadline, and the required lease was signed by Piornack, as managing partner of “Spice Cantina, LLC”, even though Piornack is a member of Greensboro Parking Group, LLC, which is listed as the landlord. The City declined further comment on whether the “up-fit funds of $179,000” for the restaurant were “available and ready to be invested”. Nancy Hoffmann did not reply for comment.

At an Economic Development Committee meeting on April 11, Marikay Abuzuaiter raised the issue of oversight on various loans, grants and incentives provided by the City, specifically citing the Greensboro Parking, LLC loan, and informed her colleagues that Momentum had not satisfied the requirements of the resolution passed by City Council. Abuzuaiter thinks there may be more unfulfilled, undisclosed contracts.

In December, 2013, the contract was amended by City staff without formally informing City Council, extending the “Time of Performance 7/31/2013, to 12/31/2013”. The document states “The City contact for all matters including request for payment and reporting under this agreement shall be Kathi Dubel. Dubel, like former City Manager Denise Turner Roth, served as a lobbyist for the Greensboro Partnership before working for the City.

The City appears to have extended a noncompliant contract after payments were made and obligations not produced, which now looks like it’s in default."
